Under New York law, the owner or caretaker of a dog that had previously been declared a “dangerous dog” is strictly liable for the victim’s medical costs. If a person is bitten by a dog that is not deemed a dangerous dog, or if a victim seeks to recover other types of damages, such as property damage, it must typically be demonstrated that the dog’s owner was aware of the dog’s dangerous tendencies or that the owner acted negligently, such as by failing to keep their dog on a leash or in a secure enclosure.
