How Does Divorce Mediation Work in New York?

When a couple begins the divorce process, there is usually a great deal of emotion involved, especially if one spouse wants the divorce and the other does not. The Divorce Mediation Process

Spouses can meet with a mediator on their own or with separate attorneys present. During mediation sessions, they discuss and finalize agreements on all necessary legal issues involved in ending their marriage, including child custodychild support, spousal maintenance, and the division of marital assets.

The mediator facilitates the discussion and provides a calming influence when emotions flare up or contentious issues arise. Again, spouses do not have to agree on everything, but they do need the desire to work through the various issues together instead of leaving the decisions up to a judge.
